1. Scope and Purpose
These Terms and Conditions (hereinafter „T&C“) apply to all purchase contracts concluded between Weinverstand(hereinafter „Seller“) and the customer (hereinafter „Buyer“) via the website and the checkout system powered by SendOwl/Stripe.
2. Formation of Contract
2.1. The product descriptions in the online shop do not constitute binding offers. 2.2. By clicking the „Purchase“ or „Pay Now“ button, the Buyer submits a binding offer to purchase the digital PDF report. 2.3. The contract is concluded when the Seller sends an order confirmation and the digital download link to the email address provided by the Buyer.
3. Pricing and Payment
3.1. All prices are final prices. As a digital service provider based in Germany, prices include applicable VAT unless otherwise stated. 3.2. Payment is processed via Stripe. The Buyer is responsible for any fees incurred by their own banking institution. 3.3. The digital product remains the intellectual property of the Seller but is licensed to the Buyer upon full payment.
4. Delivery of Digital Goods
4.1. The delivery of the PDF report is carried out automatically via a download link provided by SendOwl. 4.2. The Seller is not responsible for non-delivery resulting from an incorrect email address entered by the Buyer or filtered by the Buyer’s spam settings.
5. Mandatory Waiver of Right of Withdrawal (EU Law)
5.1. Important: By purchasing digital content, the Buyer expressly agrees that the execution of the contract begins before the expiry of the statutory 14-day withdrawal period. 5.2. The Buyer acknowledges that by checking the box at checkout, they lose their right of withdrawal once the download of the digital PDF has started or the link has been provided.
6. Refund Policy
6.1. Due to the nature of digital downloads, all sales are final. 6.2. No refunds will be issued once the link has been delivered, except in cases where the file is proven to be technically defective and a replacement cannot be provided.
7. Limitation of Liability
7.1. The Seller is liable for damages caused by intent or gross negligence. 7.2. For simple negligence, the Seller is only liable for breaches of „cardinal obligations“ (duties essential to the contract). In such cases, liability is limited to the typical, foreseeable damage (the purchase price of the report). 7.3. The Seller shall not be held liable for the accuracy of any wine ratings or for the financial performance of wine investments, as the information contained in this report is provided solely for informational purposes and does not constitute investment advice or recommendations.
8. Final Provisions
8.1. Governing Law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). 8.2. Jurisdiction: If the Buyer is a merchant or a legal entity under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Hamburg, Germany. 8.3. If any provision of these T&Cs is found to be invalid, the remaining provisions shall remain in full force and effect.

1. Acceptance of Service
By accessing the Weinverstand website and purchasing our Bordeaux Wine Reports, you agree to be bound by these Terms of Service. These terms govern your access to and use of the digital content provided by Weinverstand.
2. Service Description
Weinverstand provides digital wine analysis and reports in PDF format. The service is considered „rendered“ the moment a download link is generated and delivered to your provided email address via our third-party processor, SendOwl.
3. User Conduct & License Restrictions
Access to the PDF reports is granted on a Single-User/Personal Use basis. As a condition of your use of this service, you agree not to:
- Share, distribute, or broadcast the PDF reports to any third party.
- Modify, decompile, or attempt to extract the underlying data for commercial use.
- Circumvent any digital rights management (DRM) or „stamping“ applied to the files.
- Use the reports in any way that infringes upon the intellectual property rights of Weinverstand.
4. Payment and Delivery
- Processing: All financial transactions are handled by Stripe. Weinverstand does not store your credit card information.
- Delivery: Delivery is automated via SendOwl. It is your responsibility to provide a valid email address. If you do not receive the link within 1 hour, you must contact us to rectify the delivery.
5. No-Refund Policy
Weinverstand provides „intangible, irrevocable goods.“ As such, we do not issue refunds once the service has been performed (the download link has been sent). By checking the box at checkout, you acknowledge that you waive your right to a refund for this digital service.
6. Modifications to Service
Weinverstand reserves the right to modify or discontinue the service (or any part of the content) without notice at any time. We shall not be liable to you or any third party for any modification, price change, or suspension of the service.
7. Intellectual Property
All content included in the reports—including text, graphics, logos, and data compilations—is the property of Weinverstand and protected by international copyright laws.
8. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Germany. Any legal action regarding these terms shall be filed in the courts of Hamburg.
